Decision on the amount of registration fee in the directory of lawyers

The Bar Association of Belgrade informs the public that the Constitutional Court of Serbia has issued a decision in case Uo.104/2015 dated October 15, 2020, rejecting all initiatives to initiate proceedings for assessing the constitutionality and legality of the provisions of Articles 1, 2, and 14 of the Decision on Registration Fees and Charges for Registration in the Register of Lawyers, the Register of Lawyer Trainees, the Register of Joint Law Offices, and the Register of Lawyer Partnerships No. 476-4/2014 dated June 22, 2014.

In the past period, we have witnessed open advocacy by a number of lawyers who sought to challenge this decision. Such efforts were motivated by financial interests, as they aimed to create a legal basis for initiating court proceedings for damages against the professional association to which we all belong. Without delving into the moral dimension of such actions, we regret to state that some colleagues, driven by personal interests, disregarded the harmful consequences their actions could have on the entire legal profession.

With the decision of the Constitutional Court of Serbia, any challenge to the decision of the Bar Association of Serbia, which prescribes the registration fee for the lawyer register, has been conclusively put to rest. The distinction between candidates who gained professional experience as lawyer trainees and those who gained experience outside the legal profession has been upheld.

In short, the principle has been defended that only lawyer trainees may apply for a reduced registration fee in the lawyer register and pay a fee of 500 euros instead of 4,000 euros.

The Bar Association of Belgrade considers this yet another significant victory for the legal profession in its consistent advocacy for the goals prescribed by the Statute, including the principle of renewing the legal profession through its own trainees to maintain the vitality of our profession.
